HANSA-PARK General Event Terms and Conditions (AGB)

The subsequent General Event Terms and Conditions apply to the conference and event rooms made available by HANSA-PARK (subsequently referred to as HP) as well as to all supplies and services associated with it and delivered to the contractual partner (subsequently referred to as Event Organiser). Potentially conflicting or deviating terms and conditions of the Event Organiser shall not apply.

1. Cancellations

Upon confirmation of the order HP immediately starts making preparations such as, for example, hiring staff and engaging the services of performers. In the event of a cancellation the following costs will be incurred:

If the Event Organiser cancels an event up to 30 days prior to the event date, the Event Organiser has to pay 50 per cent of the total price agreed upon. If the Event Organiser cancels an event up to 7 days prior to the event date, the Event Organiser has to pay 80 per cent of the total order value. If the Event Organiser cancels an event at short notice, i.e. less than 7 days prior to the event date, the Event Organiser has to pay 90 per cent of the total order value. The Event Organiser has the right to show proof that HP has suffered less damage.

2. Contract Conclusion

HP considers any agreement on deliveries and services binding only if the Event Organiser has confirmed in writing the offer made by HP and thus placed a firm order.

3. Number of Participants

For events which include the serving of food and/or beverages, the Event Organiser has to advise HP the exact number of participants and the choice of food and menus 4 weeks prior to the event at the latest. The information provided is binding and the final details are considered guaranteed order elements. The final figures provided will be the minimum invoiced by HP.

Food and beverages as well as tobacco products and other goods ordered in addition to the final quantities will be billed separately based on the currently valid list prices applicable to events at HP. If the number of participants stipulated in the firm order increases by 5 per cent or more, HP reserves the right to change the menu order agreed upon. If the number of participants decreases by 5 per cent or more, HP will recalculate its offer and any additional costs will have to be borne by the Event Organiser.

4. Prices and Terms of Payment

Unless otherwise agreed upon, all prices are inclusive of value added tax, service charges and all other taxes that may apply. If the value added tax is raised in the period between the conclusion of the order and the event date, the Event Organiser has to bear the increase in costs.

If the period between the conclusion of the order and the actual date the event takes place is longer than 90 days, HP reserves the right to change its prices if the costs and wages the original quote has been based on have increased in the meantime.

Payment of HP’s invoices must be made net within 8 days upon receipt of the invoice.

5. Charging of Beverages

Unless otherwise agreed upon, beverages will be offered on an “all-inclusive” basis and are included in the total order value agreed upon.

If additional beverages are ordered or ad-hoc changes are made on site, any additional beverages served will be charged by consumption.

6. Food and Beverages brought in

The Event Organiser is not permitted to bring in his own food or beverages for the events unless it has been agreed upon in a special agreement.

7. Limitations of Liability

We can only be held responsible for damages caused intentionally or by gross negligence on the part of our staff. In particular, we do not assume any liability for theft, loss of or damage to personal items or property brought on to HP’s premises.

If due to force majeure such as, e.g. bad weather or ongoing maintenance and repair work, individual attractions cannot be operated or show programmes cannot be performed, the Event Organiser is not entitled to claim any refund or demand a reduction of the total order value agreed.

Please note that TÜV regulations prohibit persons who appear to be / are under the influence of alcohol to get on our rides. This also applies to participants in evening events. If they do not comply with it, we reserve the right to close ride attractions early if required. This is to ensure the safety of our guests at all times. For more details please refer to item 10 of our General Terms and Conditions.

Guests are responsible for themselves and their behaviour. If a person under the influence of alcohol causes damage – be it injury to life, body or health or damage to property – that person will be the only one who is responsible for it. HANSA-PARK cannot be held liable for the actions of event participants both inside the event facilities and on the way from the respective facility to the Park’s exit.  

As the holder and organiser of the event it is your responsibility to ensure that all participants leave the Park safely and no one drives home while intoxicated.

8. Reporting of Damages

All facilities in the Park are carefully maintained and monitored. Should you nevertheless suffer damages not caused by you, please report the damage to our staff at Information prior to leaving the Park area or, during an event, to the event management. Please also report to Information if you have reason to believe that damages may arise from an incident at a later date.

No compensation for damages will be paid at all if they are reported after the above-mentioned period of time and/or after leaving the Park area.

9. Technical Facilities

In as far as HP, on behalf of the Event Organiser, hires technical or other equipment for the event from third parties, HP acts in the name and on account of the Event Organiser. The Event Organiser is responsible for taking proper care of the equipment and has to return everything in good order and condition. The Event Organiser indemnifies HP against all third-party claims arising from permitting the use of the equipment.

10. Termination by HANSA-PARK

HP is entitled to terminate the contractual relationship without observing any expiry dates at any time if the event tarnishes the reputation or endangers the safety of HP. That also applies in the event of force majeure or upon good cause shown. In this case, the Event Organiser cannot claim any compensation for damages.

11. Place of Jurisdiction

The place of performance is Sierksdorf/Baltic Sea and the place of jurisdiction is Oldenburg/Holstein. The place of jurisdiction also applies if the Event Organiser has no general place of jurisdiction in Germany. The final order is exclusively governed by the laws of the Federal Republic of Germany.

12. Final Provisions

If individual provisions of these General Event Terms and Conditions are deemed to be invalid, such invalidity does not affect the validity of any other provisions of these Terms and Conditions. The invalid provision will be replaced by an enforceable provision that best matches the economic purpose of the unenforceable provision. In order for deviating agreements or supplement agreements to be legally effective, they must be made in writing. In particular that applies to this provision and all other provisions of these General Event Terms and Conditions.

The Park Rules and Regulations of HP apply. We will be pleased to provide them on request.
